The regular meeting was called to order by Chairman Maroney at 8:00 A.M. in the Commissioners Room at the Courthouse.  Commissioners present:  Worth, Arbach and Williams.  Also in attendance Randall Simon.
DISTRICT I COMMISSIONER
APPOINTMENT
Moved by Williams, seconded by Arbach to appoint Randall Simon as District I Commissioner to fulfill the vacated position held by Ray Shellito, who resigned due to health reasons.  All voted aye.  Motion carried.
MINUTES
Moved by Arbach seconded by Worth to approve the November 5, 2013 minutes as read.  All voted aye.  Motion carried.
JOINT COOPERATIVE
AGREEMENT
Moved by Williams, seconded by Worth to authorize Chairman Maroney to sign the JCA for 2014 between Potter County and Northeast Council of Government. All voted aye.  Motion carried.
LIBRARY ASSISTANT
Moved by Worth, seconded by Maroney to hire Lesa Schmidt as Library Assistant at $11.00 per hour.  All voted aye.  Motion carried.
CONTINGENCY TRANSFERS
Moved by Williams, seconded by Arbach to authorize the following contingency transfers, budget only.  All voted aye.  Motion carried.

STATES ATTORNEY
SA Smith and Cindi Forgey, DOE, met to discuss what should be charged for the record copies in the Dir. Of Equal. Office.
RECORD COPY FEES
Moved by Arbach, seconded by Simon to charge $125.00 as a minimum charge and $50.00 per hour after the first 2 initial hours it takes to copy the records.  All voted aye.  Motion carried.
BUILDING PERMITS ORDINANCE
– FIRST READING
Commissioner Williams presented the following ordinance and moved for its first reading.
AN ORDINANCE REQUIRING THE PROCUREMENT OF BUILDING PERMITS
The County Commissioners of Potter County, South Dakota do ordain as follows:
SECTION ONE.
BUILDING PERMITS
From and after the effective date of this ordinance, no person, partnership, corporation, legal entity or owner of real property shall, within Potter County, erect or construct, or commence the erection or construction of, or alter or commence the alteration of, any type of structure or building without first obtaining a building permit in accordance with the provisions and procedures set forth in this ordinance.
SECTION TWO.  DEFINITIONS –
BUILDING OR STRUCTURE
The terms “building” and “structure” shall be defined as any house, building, outbuilding, grain bin and any attachment thereto, quonset, shop, shed or shelter, or any portion thereof.
SECTION THREE.  PERMITS
Permits are necessary for any improvements on or to: (1) any structures/buildings in which the fair market value of the improvement exceeds Five Thousand Dollars ($5,000); (2) any structure or building, regardless of cost if additional land or area is required for it to be sited on; or (3) any improvement of any kind or nature upon real property that exceeds Ten Thousand Dollars ($10,000).
SECTION FOUR.
APPLICATION FOR PERMITS
Application for a building permit shall be made to the Potter County Director of Equalization on forms prescribed and furnished by the Potter County Director of Equalization and shall be accompanied by a permit fee of $25.00.  Each application for a building permit shall also be accompanied by specifications for the proposed construction or alteration as requested on the permit in a format approved by the Potter County Commissioners by resolution.
SECTION FIVE.
ISSUANCE OF PERMIT
If the application is approved by the Potter County Director of Equalization, the Potter County Director of Equalization shall issue the requested permit.
SECTION SIX.  POSTING PERMIT
The sole purpose of the permit is to identify improvements to real property in Potter County, excluding all real property within the boundary of an existing municipality for the purposes of determining its taxable value, if any.  Post of permit is not required.
SECTION SEVEN.
VESTED RIGHTS
No person, partnership, corporation, legal entity or owner shall acquire any vested right to construct, alter, or maintain any building by virtue of issuance of a building permit required by the terms of this ordinance, and shall abide by all other county, state and federal rules, ordinances or laws.
SECTION EIGHT.
EFFECTIVE DATE
This ordinance shall become effective three (3) days after proper publication of the ordinance.
SECTION NINE.  PENALTY
Any person or persons, firm, partnership, corporation legal entity or owner violating any provision of this ordinance shall, on conviction of the violation, pay a fine of $200, together with costs of prosecution.
Commissioner Simon seconded the foregoing ordinance.  All present voting aye.
HIGHWAY DEPT.
Supt. Smith met to discuss selling the 140G Motor Grader thru the Use Cat Auction Service. Further discussion to be held nearer to the desired time of disposal.
FUEL QUOTES
Supt. Smith presented the following fuel quotes for the month of Dec.
Hoven Coop  $3.46; NCFE  $3.476;  NPC $3.425.  Successful bidder NPC @ $3.425.
FAIR BOARD
Dale Nauman met to discuss the activities of the Fair Board and 4-H Advisor.
SHERIFF
Sheriff Hamburger met to present the monthly activity report.  It was also reported that the amount of paper work has increased for issuing CDL driver licenses and those that go out of state for the winter.
OFFICERS REPORT
The Register of Deeds and the Auditor’s Account with the Treasurer reports were reviewed.  Moved by Williams, seconded by Worth to approve the above reports.  All voted aye.  Motion carried.  Auditor’s Account with the Treasurer as follows.
